These Terms of Use ("Terms") govern your use of the Hashtag Provider application and website (collectively, the "Service") operated by Onebillet Ltd. ("Onebillet", "we", "us", or "our"). By using our Service, you agree to these Terms.

1) Licensed Application End User License Agreement (EULA)

The Hashtag Provider application ("Licensed Application") made available through app stores is licensed, not sold, to you. Your license to the Licensed Application is subject to your prior acceptance of this End User License Agreement ("EULA") and Apple's standard EULA terms.

Important: For the most current version of Apple's standard EULA terms, please visit: Apple’s Standard EULA . These terms may be updated by Apple from time to time.

a. Scope of License

  • Onebillet grants to you a nontransferable license to use the Licensed Application on any supported devices that you own or control.
  • You may not distribute, transfer, redistribute, or sublicense the Licensed Application.
  • You may not copy, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof.

b. Consent to Use of Data

You agree that Onebillet may collect and use technical data and related information as described in our Privacy Policy to facilitate the provision of software updates, product support, and other services related to the Licensed Application.

c. Termination

This EULA is effective until terminated by you or Onebillet. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms.

d. Apple Terms Integration

Your use of the Licensed Application is also governed by Apple's standard End User License Agreement. In case of any conflict between these terms and Apple's EULA, Apple's terms shall prevail for App Store distributed versions.

2) Purchases and Refund Policy

For Subscriptions Purchased via App Store

All transactions made through the Apple App Store are governed by Apple's Media Services Terms and Conditions. As such, we do not have the ability to issue refunds for purchases made through the App Store. All refund requests must be submitted directly to Apple. You can typically request a refund at reportaproblem.apple.com.

For Subscriptions Purchased via our Website

For subscriptions purchased directly on hashtagprovider.com, we offer a 7-day money-back guarantee. You may request a full refund within 7 days of your initial purchase by contacting our support team at support@onebillet.com with your purchase details. Refunds are processed within 3–5 business days to the original payment method.

Subscription Cancellation

You can cancel your subscription at any time. You will retain access to the Pro features until the end of your current billing period.

3) Third-Party Services and Terms

  • AI Hashtag Generation: Our AI features are powered by DigitalOcean Agents. By using the hashtag generator, you acknowledge and agree to be bound by DigitalOcean’s applicable terms of service and acceptable use policies.
  • Payments: Payments on our website are processed by Stripe, and in-app payments are processed by Apple. These transactions are subject to their respective terms and privacy policies.

4) Acceptable Use Policy

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable;
  • Violate any applicable laws or regulations;
  • Infringe upon intellectual property rights of others;
  • Generate spam, misleading, or deceptive hashtags;
  • Attempt to circumvent usage limits or restrictions;
  • Reverse engineer, hack, or attempt to gain unauthorized access to the Service.

5) Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Onebillet Ltd. and its licensors. The Service is protected by copyright, trademark, and other laws.

User-Generated Content: You retain ownership of content and hashtags you create using our Service. However, you grant us a limited license to process and display your content as necessary to provide the Service.

6) Service Availability and Modifications

  • Modify, suspend, or discontinue the Service at any time;
  • Update these Terms as needed;
  • Change pricing or features with reasonable notice;
  • Implement usage limits or restrictions.

We strive to provide high uptime but cannot guarantee uninterrupted service availability.

7) Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

8) Disclaimer of Warranties

DISCLAIMER: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONEBILLET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9) Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL ONEBILLET BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10) Indemnification

You agree to indemnify and hold harmless Onebillet Ltd. from any claims, damages, and expenses arising out of your use of the Service or violation of these Terms.

11) Termination

We may terminate or suspend your access immediately, without prior notice, for any reason, including a breach of these Terms. Upon termination, your right to use the Service will cease immediately.

12) Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Ontario, Canada. Any disputes arising from these Terms shall be resolved through binding arbitration in Toronto, Ontario, Canada.

13) Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms and updating the "Last Updated" date.
